2. Products and Artwork

All artworks sold on this website are original pieces unless otherwise stated.

  • Each artwork is unique and may include minor imperfections inherent to handmade work.

  • Colours may vary slightly due to screen display differences.

  • Once sold, original artworks cannot be replicated.

We reserve the right to modify or discontinue any product without notice.

  • All prices are listed in AUD (Australian Dollars) unless otherwise stated.

  • Prices are subject to change without notice.

  • Payment must be made in full before an order is processed and shipped, unless otherwise agreed (e.g. commissions with deposits).

  • We use secure third-party payment processors and do not store payment details.

4. Orders and Acceptance

We reserve the right to refuse or cancel any order for reasons including:

  • Product availability

  • Errors in pricing or description

  • Suspected fraudulent activity

If your order is cancelled after payment, you will receive a full refund.

5. Shipping and Delivery

  • Shipping costs and estimated delivery times are provided at checkout.

  • Delivery times are estimates only and may vary due to external factors.

  • We are not responsible for delays caused by couriers or customs.​

Customers are responsible for providing accurate shipping information. We are not liable for lost shipments due to incorrect addresses.

6. Returns and Refunds (Including Australian Consumer Law)

Due to the nature of original artwork, all sales are generally final. However, this does not override your rights under the Australian Consumer Law (ACL).

Under the ACL, you are entitled to a repair, replacement, or refund if a product:

  • Has a major fault

  • Is not as described

  • Is not of acceptable quality

  • Is not fit for its intended purpose

If your artwork arrives damaged or faulty:

  • Please contact us within 7 days of the item being delivered

  • Provide photographic evidence of the issue

  • If a return is approved, we will offer a remedy in accordance with the ACL.

We do not offer refunds for change of mind.

7. Commissions

We may offer custom commissioned artworks.

  • Commission Process:

  • A non-refundable deposit of [e.g. 30–50%] is required before work begins.

  • The remaining balance must be paid prior to shipping or delivery.

  • Client Responsibilities:

  • You agree to provide clear and accurate instructions for the commission.

  • Delays in communication may impact completion time.

  • Revisions:

  • We may offer a limited number of revisions during the creation process.

  • Significant changes outside the original brief may incur additional fees.

  • Cancellations:

  • Deposits are non-refundable once work has commenced.

  • If a commission is cancelled after substantial progress, additional fees may apply.

  • Artistic Rights:

  • We retain creative control over the final artwork while making reasonable efforts to follow your brief.

8. Intellectual Property

All artwork, images, and content on this website are the intellectual property of J.Halliday Studio unless otherwise stated.

  • Purchasing an artwork does not transfer copyright.

  • You may not reproduce, distribute, or use the artwork for commercial purposes without written permission.

We reserve the right to use images of sold or commissioned artwork for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.

9. User Conduct

  • You agree not to:

  • Use the website for unlawful purposes

  • Attempt to interfere with website security

  • Submit false or misleading information

10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages arising from the use of our website or products.

  • Our total liability is limited to the purchase price of the item.

Nothing in these Terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law.
